“Agreement” refers to this document, including any addenda or materials provided. “You” or “Your” refers to the renter, anyone signing this Agreement, and any Authorized Driver. “We,” “Our,” or “Us” refers to Pristine Exotics. “Vehicle” refers to the car in this Agreement, including all accessories and documentation. “CDW” refers to Collision Damage Waiver.
This Agreement governs the Vehicle rental. You agree to indemnify and protect us from any claims, liabilities, costs, or legal fees. We do not offer warranties, express or implied, regarding the Vehicle.
Return the Vehicle in the same condition as received, except for normal wear. Repairs or services during the rental must be approved by us. You are responsible for checking and maintaining fluid levels. We may repossess the Vehicle without notice if misused or abandoned.
You are liable for damage, loss, missing equipment, or any related fees. Report accidents, theft, or vandalism within 24 hours and to the police immediately.
If you accept CDW, we waive our right to collect for damage or loss. However, we do not waive this right if damage is caused by:
(a) intentional misconduct;
(b) driving under the influence;
(c) towing or pushing;
(d) driving on unpaved roads;
(e) commercial or illegal use;
(f) racing or training;
(g) unauthorized drivers;
(h) driving outside the U.S.;
(i) providing false information.
You are responsible for damage or loss to the Vehicle or others. You must have primary auto liability, collision, and comprehensive insurance. You must also have uninsured motorist coverage. If unauthorized drivers use the Vehicle, our liability insurance will be void. This Agreement is governed by the laws of the state where liability occurs.
You agree to pay for:
(a) rental time and mileage;
(b) additional driver fees;
(c) optional products;
(d) fuel charges if the Vehicle is returned with less fuel;
(e) taxes;
(f) repair or replacement costs;
(g) fines, towing, and storage fees;
(h) recovery costs;
(i) attorney’s fees;
(j) late payment fees;
(k) interest;
(l) cleaning fees up to $150.
We may apply your deposit to any amounts owed. We are not liable for personal property loss or damage in the Vehicle or offices.
Acts listed in Section 5 are prohibited and constitute breaches. Allowing unauthorized drivers to operate the Vehicle is a breach. You waive recourse for any criminal proceedings initiated due to this Agreement.
No terms can be changed unless in writing by us. To extend the rental, return the Vehicle for inspection. This Agreement contains the entire understanding between you and us and supersedes prior representations.
Waiving one breach does not waive others. Acceptance of payment or failure to act does not waive any terms. You release us from liability for any consequential, special, or punitive damages. If any part of this Agreement is invalid, the rest remain valid.
